Definitions

  1. IMG or website or Irish Made Gifts refers to www.irishmadegifts.com
  2. User is a person who accesses the website by the URL www.irishmadegifts.com or associated URI/IP addresses. 
  3. Registered User can refer to either a buyer or seller who has registered their details according to the procedures set out on the website
  4. Supplier means those providing a service or supplying goods of a tangible or intangible nature, in relation to the website.
  5. Buyer means those who buy a product using the website.
  6. Services means all of the functional services provided by the website, including the provision of a store front and related technical means for facilitating the sale of products. Services also includes the technical, managerial and operational services provided by the website in delivering the functional services. 

 

Introduction

The use of the website is governed by the terms and conditions set out below. These terms and conditions are important and are there for the protection of both users and its agents. Please take the time to read them carefully. By using the website you will be deemed to have accepted them and that your use is at your own risk.

This website provides a convenient intermediary facility for purchasing goods handmade in Ireland.   Irishmadegifts.com, is not a party to any contract between buyer and seller, but arranges the sale. No contract is deemed binding for either the buyer or supplier until the item(s) selected are shipped by the supplier. Full details for each supplier are available prior to payment, and should any issues arise surrounding delivery or the product, the supplier should be contacted in the first instance. Should any issue not be resolved successfully in this manner, Irish Made Gifts should then be notified and will review the matter.

 

Jurisdiction

The website is established in Ireland in accordance with the laws of Ireland and shall be governed by the laws of that country. When you use the site, you accept that your use of the site and any information on the site, shall also be governed by the laws of Ireland and if any dispute arises from your use of the site or any of the information on it, you agree to allow such dispute to be heard in the Irish courts. 

 

Function of the website

The website is providing a service which facilitates the transfer of data and communication between users, buyers and sellers. The provision of this service does not:

  • Imply approval of such products by the website.
  • Imply a preference of such products over any other similar products.
  • Imply any liability on the part of Irish Made Gift’s part for the accuracy, veracity and completeness of data prepared by these products, for any errors arising from the use of these products and for any damage arising from the use of these products. 
  • Imply that Irish Made Gifts is a party to any contract between buyer and seller. 

 

Site Content

In the event that a Supplier uploads or otherwise transfers material to the website, Irish Made Gifts and its agents have no responsibility for the accuracy, veracity and completeness of same and for any errors in the manner of its input. Product content is provided and uploaded by individual suppliers.

 

Accuracy of Content

Whilst we make all reasonable efforts to ensure the accuracy of all information on the IMG website, including product information, availability and pricing, occasionally there may be errors which we fail to notice for we do not accept any liability.  In addition such information is only up to date as at the time you visit the web site.  We reserve the right to correct any errors and to change any information (including products, availability, pricing and delivery charges) at any time without notice. If any change affects an order you have submitted, then we will give you the opportunity to cancel the order rather than accept the change.

 

Liability and Disclaimer

Irish Made Gifts, its officers or its agents:

  • Shall not be liable for any delays, interruptions, errors or failures in the provision of the services not within the reasonable control of Irish Made Gifts and its agents including force majeure, failure or fluctuation of electrical power, industrial action, industrial disputes, breakdown or other malfunctions of the user’s or the website’s or its agents’ telephone or other technical equipment, including software;
  • Do not accept responsibility expressed or implied for the accuracy, suitability, usefulness, and completeness or otherwise of the information and data contained on this site; 
  • Shall not be liable, either in contract or in tort, for any direct, incidental, consequential, indirect or punitive damages or any other losses, costs, expenses or damage of any kind claimed to have arisen as a result of using this site or as a result of the non-availability, non-functioning or malfunctioning of the services or otherwise in connection therewith;
  • Do not warrant that the information and data contained on this site or sites linked to this is free from infection by computer viruses or that it does not infringe the intellectual property rights of any person anywhere in the world; 
  • Do not authorise the infringement of any intellectual property rights contained in material in other sites linked to this site; 
  • Do not accept responsibility for any errors in transmission or downloading documentation from this site; 
  • Do not accept responsibility for non-adherence by individual suppliers to their legislative obligations.
  • Do not accept responsibility for the accuracy, suitability, usefulness, and completeness or otherwise for material contained on other websites linked to this site; 
  • Is a conduit for the provision of a means of communication between parties contracting at arm’s length. Irish Made Gifts is an intermediary service provider within the definition of Directive 2000/1/EC and S.I 68 of 2003. It provides a service whereby it facilitates the making of contracts between two or more persons and the relevant service provided by him or her consists of the provision of access to a communication network;
  • Without prejudice to the foregoing hereby disclaims any obligations under the various guarantees which may be offered from time to time by manufacturers of products insofar as permitted by law;
  • Reserves the right to amend this disclaimer as and when required without notice by updating this document.  

 

Supplier Obligations

Suppliers using Irish Made Gifts are obliged to conform with the European Directive on Distance Selling (Directive 97/7/EC). It should however be remembered that this does not apply to customised goods (i.e. personalised gifts).

Suppliers are also bound by the terms of the Sale of Goods and Supply of Services Act 1980 and the European Directive on certain aspects of the sale of consumer goods and associated guarantees (1999/44/EC). Some goods may carry a guarantee which does not affect your statutory rights, however for the avoidance of any doubt, Irish Made Gifts is not a seller within the meaning of Section 17 of the 1980 Act and/or Article 1 of the 1999 directive. 

By their use of the Irish Made Gifts website to market their goods, agree to indemnify Irish Made Gifts against any claims of whatsoever nature due to the negligence and default of the supplier. 

Suppliers use of the Irish Made Gifts website agree to unconditionally and indefinitely license all copyright, trademarks and any such other intellectual property in the images and text uploaded to the Irish Made Gifts website. Irish Made Gifts may edit any such content uploaded to assist with Search Engine Optimisation, but without changing the meaning or terms of the content.  

 

Technical Steps to Creation of Contractual Relations between Buyer and seller

  1. A buyer selects a product that they wish to buy from one of our suppliers.
  2. The buyer will proceed to the shopping cart, confirm product and quantity.
  3. The buyer will pay for the goods using one of our payment methods. Prices are displayed in Euro and where possible include applicable taxes, packaging and delivery charges.  Where goods are purchased for delivery outside of Ireland, they may be subject to import duties and taxes on delivery. The buyer is responsible for payment of such import duties and taxes. If you are unsure, please contact your local customs office for further information before placing your order. 
  4. A binding contractual agreement is formed when the supplier has accepted the order from the buyer through www.irishmadegifts.com and has shipped the goods in accordance with the supplier obligations as outlined above. 
  5. The purchase price will be held by Irish Made Gifts as a stakeholder for a period of 30 days.
  6. Should there be no delivery in this period, or should the product be faulty or unsuitable within this period, Irish Made Gifts will refund the purchase price directly to the method of payment.
  7. After 30 days, payment will be released to the supplier, and any issues regarding defective or faulty goods will have to be addressed directly to the supplier.
  8. Any unwanted goods should be returned within seven days in accordance with our returns policy. 
  9. At no point is Irish Made Gifts an agent of buyer or supplier, but merely a facilitating intermediary. Should a buyer experience problems with a supplier, this should be brought to the attention of Irish Made Gifts, who will endeavour to resolve any issues. 

 

Returns Policy

Where goods are not faulty or defective the following shall apply to all sales:

  1. Goods must be returned within seven days of receipt to the supplier.
  2. Goods must be in perfect condition and ready for resale.
  3. Packaging must be in an 'as new' state.
  4. Earrings and customised goods cannot be returned. 
  5. The cost of returning unwanted/unsuitable items to the maker is the responsibility of the purchaser. 

 

Where goods are faulty or defective the following shall apply to all sales:

  1. Faulty or Defective goods may be returned to the maker within 30 working days of receipt and we will arrange a replacement or failing that, a refund.
  2. Prior to returning the item, please contact Irish Made Gifts to receive a Product Return Code to ensure the item is accurately tracked. Include this code with the returned item.
  3. Include all packaging with returned goods.
  4. The cost of returning items to the maker is the responsibility of the purchaser, but should the goods be found faulty on inspection, your card will be credited with the return postage costs. 

 

Cancellations

Where a buyer wishes to cancel their account, cancellations must be made within seven days via email to info@irishmadegifts.com.

 

Security

While all reasonable security precautions have been taken by Irish Made Gifts and its agents, including the provision of a secure and robust operating environment, the nature of communication by the Internet is such that irishmadegifts.com cannot absolutely guarantee the privacy or confidentiality of communications transmitted via the Internet from interference by third parties.
